Understanding the Complexities of Child Custody in New York State

Under New York law, child custody decisions must be made based on the best interests of the child. Every case is unique, and it is up to the parents (in settlement negotiations) or the judge (in litigation) to determine which arrangements will turn out to be in the child’s best interests.

There are a number of different legal concepts associated with child custody, including:

  • Physical custody: Who is responsible for providing the child with a permanent home?
  • Legal custody: who is responsible for making decisions about the child’s upbringing?
  • Parental access: How often and when does a noncustodial parent get to visit the child?
