Once you have gotten married, most types of assets acquired by either spouse are considered marital property. In a divorce case, the court has the power to distribute this martial property equitably between the two spouses. Common property division issues in divorce cases include:

  • If one spouse owned a business prior to the marriage but the value of the business grew during the marriage, is a portion of the business considered marital property?
  • If the spouses own a home together and it is not practical to sell it, which spouse gets to live in the home, and will that spouse be required to buy out the other’s share?
  • If one spouse acquired substantial retirement savings during the marriage is the other spouse entitled to a share of those savings? If so, how should they be divided?
